Your ticket is a receipt for your purchase and represents one opportunity to win the house at 1400 West Silver Shoals Road, Eastanollee, GA 30538. The winner assumes all responsibility for any state, county or federal taxes or fees. Ticket purchases are not tax deductible. All tickets are non-refundable as there will be final winner. Winning ticket holders need not be present to win. Ticket sales shall end at 12:01 am on December 31, 2009, unless the deadline is extended and announced by Seed Sowers Inc. By purchasing a house raffle ticket, winners agree to allow Seed Sowers Inc. to release their names and use their likeness to promote the house raffle, or to announce the winners. No compensation will be given for the use of photos or testimonials. Winners will also be listed on this website within 10 days of raffle drawing. The Seed Sowers Inc. House Raffle ( ' Raffle ' ) begins on July 7, 2009 and ends on December 31, 2009 ( ' Raffle Period ' ), unless extended according to the terms contained herein. The Raffle is conducted by Seed Sowers Inc., 183 S. Grant St., Alto, GA 30510. The Official Rules of the Raffle are set forth herein. By entering the Raffle, Entrants agree to be fully and unconditionally bound by these Official Rules, waive any right to claim ambiguity in the Raffle or these Official Rules and further agree to be bound by Seed Sowers Inc. decisions and interpretation of these Official Rules. Seed Sowers Inc, is a 501(c)(3) non-profit organization registered with the Secretary of State of Georgia since 1999. This raffle is for the support of its stated mission. Seed Sowers Inc. is a not for profit organization developed to outreach to those with special needs. Special needs are defined not only as those with physical or mental challenges and their caretakers, but also, single moms, dads and families in crisis. Seed Sowers Inc. may provide assistance in various ways including, benevolence, temporary shelter, mentoring, small repairs, food, referrals, etc. Seed Sowers Inc. states by ministering to individual needs the quality of one ' s life will be enhanced, encouraged and broadened in order to assist in the development of their future as well as those they will influence. 1. Eligibility. The Raffle is open to all persons age 18 and over who are legal U.S. residents physically residing in the United States and DC. Officers, directors and employees of Seed Sowers Inc., its agents, consultants, attorneys, independent accountant firms, and their spouses and children living in the same household and any other persons involved with this promotion are not eligible. The current property owner and children of the current property owner are not eligible to win. The Raffle is subject to all applicable federal, state, and local laws and regulations, and is void wherever prohibited or restricted by law. 2. How to Enter. Raffle tickets ( ' Tickets ' ) cost One Hundred dollars ($25.00US) each plus and administrative fee of Five dollars ($5.00US) per transaction. Once an Entrant ' s order is processed, Seed Sowers Inc. will return the receipt (ticket stub) electronically which will include a Ticket number(s) to the name provided on the Entry Form or to the operator. A minimum of seven thousand five hundred (7,500) tickets will be issued and available for purchase. Any Entry Form and payment received before 12:00 AM EST on December 31, 2009, or any extension thereto announced by Seed Sowers Inc., will be returned. No other refunds will be made, except as otherwise determined by Seed Sowers Inc. in its sole discretion. Subject to availability, Entrants may purchase as many Tickets as they wish. Tickets are personal and can only be in the name of one (1) individual Entrant. Entrants may not sell, donate or otherwise transfer their Ticket(s) to anyone. Prizes will not be issued to anyone other than the one (1) Entrant whose name is on the Entry Form. Title to the property shall be taken in the name as it appears on the Raffle ticket stub and is not transferable or assignable. Seed Sowers Inc. reserves the right to disqualify false entries or entries suspected of being false, and any illegible, defective, incomplete or physically altered Entry Forms and entries that do not include valid or complete payment. Seed Sowers Inc. is not responsible for printing errors in any Raffle-related material, or for lost, late, misdirected or non-delivered mail or corrupt fax messages, or any other failure to receive orders or deliver receipts prior to the drawing deadlines. All entries become the property of Seed Sowers Inc. and will not be returned. 3. Drawings. Grand Prize Drawing: One (1) random drawing will be conducted by a representative of Seed Sowers as described below. This random drawing will be held under the supervision of an independent accounting firm. Entrants need not be present to win. Drawing will be held at 1:00 PM EST on January 15, 2010, or upon the expiration of any announced extension to the Raffle Period at the property, 1400 West Silver Shoals Road, Eastanollee, GA 30538. All participants are invited. Early Bird Prize Drawings. The Early Bird Prize Drawing will be held on the first day of each month of the Raffle Period, excluding July 1, 2009 and the month containing the Grand Prize Drawing. It may be open to the public, in Seed Sowers Inc. discretion. Raffle drawing will be made at Random from the entries received prior to the date of the Early Bird Drawing. All winners of the Early Bird Drawings remain eligible to win all subsequent Early Bird Drawings (if any) and the Grand Prize Drawing. 4. Notification. Entrant whose Ticket number is drawn at the Grand Prize Drawing will be deemed the winner of the prize for that particular drawing ( ' Raffle Winner ' ). Raffle Winner will be notified by phone and/or U.S. Mail or overnight delivery using the information provided on the Entry Form ( ' Notification ' ). If any Raffle Winner cannot be located or fails to return attempts to contact him or her by 5:00 P.M. on the fifth (5) business day after Seed Sowers Inc. first attempt to contact him or her, such Raffle Winner will be deemed to have forfeited his or her prize and another Raffle Winner will be drawn. Each Raffle Winner may be asked to send an affidavit of eligibility / liability / publicity release ( ' Release ' ). Raffle Winner must provide all information requested to be eligible to win, including proof of age, proof of identity showing that the person claiming the prize is the same Entrant named on the winning Ticket and the winning Ticket stub. Unless restricted by law, each Raffle Winner will be required to complete and return the Release within fourteen (14) days of prize notification. The prize may be forfeited if Raffle Winner: (i) cannot be reached; (ii) fails to obtain all signatures on the Release and to return the documents in a timely manner as required pursuant to these Official Rules; or (iii) cannot accept or receive the prize for any reason. Raffle Winner grants permission for the use of their name, photographs/likenesses for advertising and promotion for this and similar promotions without compensation, unless prohibited by law. Grand Prize: The Grand Prize is the house located at 1400 West Silver Shoals Rd., Eastanollee, GA 30538 as presented on www.RafflingMyHouse.com: The Grand Prize Raffle Winner will receive fee simple title to the $750,000.00 (approximate fair market value) ' House ' (Grand Prize) in Eastanollee, Georgia referenced in all announcements, advertisements, and literature distributed by Seed Sowers, Inc. If less than 7,500 tickets are sold during the raffle period, Seed Sowers, Inc. may, at its sole discretion, provide an alternate grand prize equal to $50 times the number of ticket sold minus operation expenses and early bird cash amounts. The(House Is provided) ' as is ' with no guarantees or warranties from Seed Sowers Inc. as to condition, construction, or workmanship. All winners are subject to relevant federal, state and local taxes and other expenses, including transfer and other real estate expenses, and taxes, and other transfer fees in connection with any Prize are the sole responsibility of the Raffle Winner. Notification will be delivered to Raffle Winner by U.S. registered mail or overnight carrier, in Seed Sowers Inc. sole discretion, to the name and address provided on the Entry form. Notification will be to the name provided on the Entry Form. Raffle Winner will receive an IRS Form 5754 and a W2-G. Early Bird: Each Early Bird Prize is One thousand dollars ($1,000US). 6. Proceeds. Proceeds from the Raffle will benefit Seed Sowers Inc. and its ongoing charitable purposes in Georgia. Proceeds of the Raffle are for the benefit of Seed Sowers Inc. and other participating 501(c)(3) non-profit organizations registered with the Secretary of State of Georgia. 7. Odds. Odds of winning depend on the total number of Raffle Tickets sold. 8. General Conditions. The Raffle is subject to these Official Rules. These Official Rules shall not be changed by any oral statement made by any employee or other person acting on behalf of Seed Sowers Inc. By participating, Entrants agree: (i) to be bound by these complete Official Rules and the decisions of Seed Sowers Inc. which shall be final and binding; and (ii) to waive any right to claim ambiguity in the Raffle or these Official Rules, except where prohibited by law. By accepting a prize, Raffle Winner agrees to release Seed Sowers Inc., its officers, directors, employees, representatives and agents, and any person or entity associated with the production, judging, or administration of the Raffle (collectively, the ' Releasees ' ) from and against any claims, damages, disability, attorneys ' fees, and costs of litigation and settlement, as well as any liability due to any injuries, damages or losses to any person (including death) or property of any kind resulting in whole or in part, directly or indirectly, from redemption, acceptance, possession, ownership, misuse or use of any prize or participation in any Raffle-related activity or participation in this Raffle. If a sufficient number of tickets have not been sold by 12:00 AM. on December 31, 2009, an alternate raffle period ending date will be January 31, 2010 and a drawing date of February 15, 2010. Each ticket purchaser is advised to consult his or her own tax advisor(s) with respect to the tax liabilities that may arise from winning a prize in this Raffle. Seed Sowers Inc. reserves the right to disqualify any entrant it finds to be tampering with the entry process or the operation of the Raffle or violating these Official Rules, and reserves the right to cancel the Raffle should it suspect fraud or for reasons out of the control of Seed Sowers Inc. Seed Sowers Inc. shall appoint a single individual who will be responsible for maintaining control and security of the Raffle. Such individual shall, by public certification under oath at the time of the drawing, certify that all Raffle entrants have a stub in the container from which the winning Raffle ticket will be drawn. Disputes regarding these Official Rules and/or this Raffle will be governed by the internal laws of the State of Georgia. No substitutes for prizes listed. All prizes are subject to Federal and State withholding tax. Winners assume property taxes accrued after closing and subsequently thereafter, all assessments, all local, state and federal income taxes, and title closing costs, if any. Raffle Winner pays title insurance charges. Winner must claim the home on or before within 10 days after drawing. Closing must occur within 30 days after drawing. The Raffle Winner shall pay any and all of the settlement and closing costs of the transfer of title. Seed Sowers Inc. reserve the right to extend the raffle date and deadline for ticket sales. The Raffle Winner must claim prize within (10) days of the Raffle drawing date or a new winner will be selected. Winner must go to settlement on the property within (30) days of the Raffle drawing date. ANY CLAIM OR CONTROVERSY BETWEEN ANY RAFFLE PARTICIPANT AND SEED SOWERS INC. ARISING OUT OF OR RELATING TO THE RAFFLE OR TO THESE RULES AND REGULATIONS SHALL BE SETTLED BY BINDING ARBITRATION ADMINISTERED BY THE AMERICAN ARBITRATION ASSOCIATION UNDER ITS COMMERCIAL ARBITRATION RULES, AND JUDGMENT ON THE AWARD RENDERED BY THE ARBITRATOR MAY BE ENTERED IN ANY COURT HAVING JURISDICTION THEREOF. CAUTION: ANY ATTEMPT TO DELIBERATELY DAMAGE OR UNDERMINE THE LEGITIMATE OPERATION OF THE RAFFLE MAY BE IN VIOLATION OF CRIMINAL AND CIVIL LAWS AND WILL RESULT IN DISQUALIFICATION FROM PARTICIPATION IN THE RAFFLE. SHOULD SUCH AN ATTEMPT BE MADE, SEED SOWERS INC. RESERVES THE RIGHT TO SEEK REMEDIES AND DAMAGES (INCLUDING ATTORNEY FEES) TO THE FULLEST EXTENT OF THE LAW, INCLUDING CRIMINAL PROSECUTION. A Raffle Entrant ' s sole and exclusive remedy for any claim against Seed Sowers Inc. arising out of the sale of raffle tickets or the conduct of the Raffle shall be limited to the return of the purchase price paid for his or her raffle ticket(s). In no event shall Seed Sowers Inc., its directors, officers, employees, agents or representatives be liable to any party for any loss or injury to earnings, profits or goodwill, or for any incidental, special, punitive or consequential damages of any person or entity whether arising in contract, tort or otherwise, even if advised of the possibility of such damages. If for any reason the raffle is canceled, Seed Sowers, Inc. may reimburse each Raffle ticket purchaser within sixty (60) days of the Raffle cancellation date but may retain up to 10% of the ticket price for administrative costs. 9. Privacy. All personal information collected by Seed Sowers, Inc. will be used for administration of the Raffle. Seed Sowers Inc. will not share, sell or otherwise distribute personal information collected by Seed Sowers Inc. except as stated above. 10: .Official Rules And Winners List. A list of all prize winners will be posted on the raffle website on or about January 20, 2010 and a copy of the winners ' list and of these Official Rules may be obtained by sending a self-address, stamped envelope to: Seed Sowers Inc. Registration with the State of Georgia. By letter from the Habersham County Sherriff ' s Office, Seed Sowers Inc, has obtained authorization to conduct a raffle in Georgia within the year 2009.
